WHAT DO YOU DO WHEN YOU HAVE A PROFESSIONAL LIABILITY CLAIM?

  • Put the insurance company on notice right away or you may contact our office if you think you need immediate advice
  • Accept all papers without commenting and do not admit liability or direct liability to anyone
  • Allow the investigation to reveal responsibility party or parties
  • Gather complete information for your documentation
    1. Your policy information
    2. Project name or name of claimant
    3. Date, time and location of the allegation
    4. Brief description of allegation
    5. Amount of demand
    6. Brief description of your duties at the job site
    7. Any lawsuit papers or legal proceedings
  • Contact the insurance company prior to attending any conferences regarding settlement discussions about a claim or potential claim
  • Do not sign or accept settlements or releases for or from anyone with approval of the insurance company
  • IMPORTANT: Always use sub-consultants who have insurance; do not accept jobs beyond your firm’s scope unless you have an insured and licensed sub-consultant to work for you and is willing to indemnify you for your losses; and do not agree to indemnify anyone in a contract; and have your contract reviewed by a legal counsel or you may contact our Contract Review Hotline at (877) 474-2821.

WHAT DO YOU DO WHEN YOU HAVE PROPERTY/CASUALTY CLAIM?

  • File your claim by contacting the insurance company direct or our office (877) 474-2821 if you think you need immediate advice.
  • Gather all pertinent information for Business Liability (claims that involve bodily injury to others or damage to the property of others); Business Property (claims that involve damage to your business property, contents or equipment); and Auto claims:
    1. Insured’s name, drivers/passengers, names of injured parties, name of witness (if any)
    2. Vehicle information or building contents, nature of damage/injury
    3. Loss location, Date and time of loss, Brief description of loss
    4. Vehicle information or building contents, nature of damage/injury
  • Gather all pertinent information for Workers Compensation claims (claims involving bodily injury to employees):
  • Employee name, description of injury, date and time of injury and how injury occurred
  • Nature of employee’s job, pay rates, work hours, last date worked, date disability began, date returned to work
  • Name and contact information of witnesses (if any)
  • Name and address of physician/hospital
  • Type of treatment
  • Employer name, address and phone
  • State Benefit Number, Standard Industry Code, Nature of Business
  • Policy Number
  • Nature of employee’s job, pay rates, work hours, last date worked, date disability began, date returned to work
