Course Overview |
This course discusses the risks related to electronic transfer of documents and strategies for minimizing the risk. Also provides discussion regarding e-mail and website hosting. |
The participant will learn to identify the risks associated with transfer of electronic files and ownership of copyrights, analyze the risk and rewards associated with file transfers and compare the AIA and EJCDC contract schemes on these issues. |
Participants will learn how the contract documents allocate responsibility for safety and how what the architect says or does can change the contract. Participants will also learn how to protect the interests of the architect in the transmission of emails and electronic files. |

This course continues guiding the design professional in developing and negotiating professional service agreements that are reasonable and fair to all parties, while minimizing the risk of liability exposure. |
This course discusses the communication techniques to confirm your understanding of what the client is seeking and offering ideas on how to more clearly convey your position to the client and confirm that you were heard. |
The programs begins with a discussion of the Uniform Condominium Acts and residential market risks. We will also discuss legal issues and right to cure are explained. Residential claims trends will be discussed as well as condominium case studies. |
The program will begin with a discussion of the need for sustainable buildings. The history of the USGBC and LEED program will be explained. The LEED certification program is also explained. |
This program is presented to give participants a better understanding of their obligations during the CA process and providing guidance on how to handle situations that might arise. The program will also discuss legal principles which may lead to legal liability for actions taken. |

Course Overview |
Participants will learn how to identify and address liability issues associated with site visits, rejection of non-conforming work, site safety, shop drawing review, and payment certification. |
Participants will discuss negotiation strategies related to agreements they enter into for design and construction administration of projects. We will discuss educating the client as to the standard of care, and the design professional's obligations as a licensed professional. |
Participants will discuss important parts of the contracting process. Negotiations will be discussed with an emphasis on determining deal makers and deal breakers. We will also discuss the appropriate standard of care and how best to reflect that in the contract documents. |
Participants will learn the history and role of the Occupational Safety and Health Administration and the implications of the General Duty Clause for employers and employees. OSHA's Multi-Employer Policy will be discussed with a focus on how the architect can avoid being cited as a Controlling Employer. |
This program will teach participants the basics of business insurance coverage. Additional Insured status and waivers of subrogation in favor of the architect are emphasized. |
